EverTick 利用規約

この利用規約（以下「本規約」といいます。）は、Geneura株式会社（以下「当社」といいます。）が提供する iOS アプリケーション「EverTick」（以下「本サービス」といいます。）の利用条件を定めるものです。本サービスを利用することで、本規約および当社のプライバシーポリシーに同意したものとみなします。

第1条（定義）
本規約において使用する主な用語の意味は、次のとおりとします。

- 「ユーザー」とは、本サービスを利用するすべての個人をいいます。
- 「コンテンツ」とは、本サービスに投稿される写真、コメント、アルバム情報その他一切の情報をいいます。
- 「アルバム」とは、ユーザーが作成する写真・コメントの共有グループをいいます。
- 「メンバー」とは、アルバムに参加しているユーザーをいいます。

第2条（アカウント登録・管理）
- ユーザーは、Apple ID または Google アカウントを用いて登録するものとし、本サービスの利用にはログインが必須です。
- ユーザーは表示名およびプロフィール画像を設定できます。
- ユーザーは自身のアカウントをアプリ内で削除することができます。削除後の復元はできません。退会後は、アルバム・写真・コメント等の関連データも削除されます。
- アルバムの全メンバーが退出した場合、当該アルバムに含まれる写真・コメント等のデータは自動的に削除されます。

第3条（サービスの内容）
- ユーザーはアルバムを作成し、写真やコメントを投稿できます。
- アルバムは招待制であり、招待されたユーザーのみが参加・閲覧できます。
- アルバム作成日からの経過時間がリアルタイムで表示されます。
- ユーザーはフレンド機能により他のユーザーと繋がり、アルバムに招待することができます。
- ウィジェット機能により、ホーム画面からアルバムの経過時間を確認できます。

第4条（無料プランとプレミアムプラン）
- 本サービスには無料プランとプレミアムプラン（有料）があります。
- 無料プランでは、アルバム作成数および1アルバムあたりの写真追加数に上限があります。
- プレミアムプランでは、アルバム作成数および写真追加数が無制限となります。
- プレミアムプランには、月額サブスクリプション、年額サブスクリプション、買い切り（永久）の3種類があります。
- サブスクリプションは自動更新されます。現在の期間が終了する24時間以上前に自動更新をオフにしない限り、同じ期間・同じ価格で自動的に更新されます。
- サブスクリプションの解約は、iOSの「設定」→「Apple ID」→「サブスクリプション」から行うことができます。アプリを削除しただけでは解約されません。
- サブスクリプションの解約後も、既存のアルバムおよび写真の閲覧は可能です。新規作成・追加は無料プランの制限に戻ります。
- 買い切りプランは一度購入すると永久に有効であり、解約や期間の制限はありません。
- 課金はAppleのApp Store経由で処理されます。購入代金はApple IDに登録された支払い方法に請求されます。
- 返金についてはAppleのポリシーに従います。返金を希望される場合は、Appleサポートにお問い合わせください。
- 当社は、プレミアムプランの価格を変更する場合があります。価格変更は、次回更新時から適用されます。重要な価格変更の場合には事前に通知します。

第5条（禁止事項）
ユーザーは、本サービスの利用にあたり、以下の行為を行ってはなりません。

- 法令・公序良俗に違反する行為。
- 暴力・脅迫・嫌がらせ・いじめ等の行為。
- 性的な表現、未成年に関する不適切な描写。
- 詐欺、なりすまし、個人情報の晒し、著作権侵害、プライバシー侵害、スパム行為。
- 不正アクセス、リバースエンジニアリング、ボットや自動化ツールの利用。
- 第三者の権利や利益を侵害する行為。
- その他当社が不適切と判断する行為。

第6条（モデレーションと措置）
- 当社は、不適切なコンテンツおよび不正な利用を行うユーザーに対して、事前の通知なくコンテンツの削除、非公開化、アカウントの一時停止または永久停止等の措置を行うことができます。
- ユーザーは不適切なコンテンツや行為をアプリ内から通報することができます。
- ユーザーは他のユーザーをブロックすることができます。
- コンテンツの非表示機能により、特定の写真やコメントを自身の画面から非表示にすることができます。
- メンバーのキック機能により、アルバムからメンバーを退出させることができます。

第7条（知的財産権）
- 本サービスおよび本サービスに含まれるコンテンツ（当社が提供するテキスト、画像、ソフトウェア、ロゴ等）の知的財産権は当社または当社にライセンスを許諾する第三者に帰属します。
- ユーザーは投稿した写真・コメントの著作権を保持しますが、当社に対して当該コンテンツを本サービスの提供・運営のために利用する権利を無償で許諾したものとします。

第8条（外部サービスの利用）
本サービスは、以下の外部サービスを利用して運営されています。

- Firebase（Google LLC）：認証、データベース、ファイル保存、バックエンド処理、プッシュ通知、アプリ設定。
- Apple サインイン：認証。
- Google サインイン：認証。

第9条（個人情報の取扱い）
ユーザーの個人情報の収集・利用・保管・第三者提供等に関する詳細は、別途定めるプライバシーポリシーに従います。

第10条（未成年の利用）
- 本サービスは、13歳以上のユーザーを対象としています。13歳未満の方は本サービスを利用できません。
- 未成年のユーザーは、必要に応じて親権者等の同意を得て本サービスを利用してください。

第11条（免責事項）
- 本サービスは現状のまま提供し、その内容や品質について保証を行いません。
- ユーザーが本サービスを利用したこと、または利用できないことにより生じたいかなる損害についても、適用される法律上当社の責任が免責または制限されない場合を除き、当社は責任を負いません。
- 本サービスに関連してユーザー間でトラブルが発生した場合には、ユーザーは自らの責任で解決するものとします。

第12条（規約の変更）
- 当社は、法令の変更やサービス内容の変更等に応じて、本規約を変更することがあります。重要な変更を行う場合には、アプリ内通知等の方法によりユーザーに告知します。
- 変更後にユーザーが本サービスを利用した場合は、変更後の規約に同意したものとみなします。

第13条（準拠法および裁判管轄）
- 本規約は、日本法を準拠法とします。ただし、ユーザーの居住地に適用される消費者保護法やデータ保護法などの強行規定はこの限りではありません。
- 本サービスに関連して紛争が生じた場合、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

EverTick Terms of Service
Effective Date: 19 March 2026

These Terms of Service (hereinafter "Terms") set forth the conditions for using the iOS application "EverTick" and related backend services (hereinafter collectively the "Service") provided by Geneura, Inc. (hereinafter "Company" or "we"). By using the Service, users agree to these Terms and to our Privacy Policy.

Article 1 - Definitions
In these Terms, the following words have the meanings set out below:

- "User" means any individual who uses the Service.
- "Content" means any photos, comments, album information or other information posted to the Service.
- "Album" means a shared group of photos and comments created by a User.
- "Member" means a User who has joined an Album.

Article 2 - Account Registration and Management
- Users must register via Apple ID or Google account; login is mandatory to use the Service.
- Users may set a display name and profile image.
- Users may delete their accounts via the app. Deleted accounts cannot be restored. Upon deletion, albums, photos, comments and related data are also deleted.
- When all Members leave an Album, the photos, comments and other data in that Album are automatically deleted.

Article 3 - Service Description
- Users can create Albums and post photos and comments.
- Albums are invitation-only; only invited Users can join and view content.
- Elapsed time since the Album creation date is displayed in real time.
- Users can connect with other Users through the friend feature and invite them to Albums.
- A widget feature allows Users to view Album elapsed time from the home screen.

Article 4 - Free Plan and Premium Plan
- The Service offers a Free Plan and a Premium Plan (paid).
- The Free Plan has limits on the number of Albums that can be created and the number of photos that can be added per Album.
- The Premium Plan removes these limits, allowing unlimited Album creation and photo additions.
- The Premium Plan is available as a monthly subscription, annual subscription, or one-time lifetime purchase.
- Subscriptions automatically renew. Unless you turn off auto-renewal at least 24 hours before the end of the current period, your subscription will renew at the same price for the same duration.
- You can cancel your subscription via iOS Settings > Apple ID > Subscriptions. Deleting the app does not cancel your subscription.
- After cancelling a subscription, existing Albums and photos remain viewable. New creation and additions revert to the Free Plan limits.
- The lifetime purchase is valid permanently with no expiration or cancellation.
- Payments are processed through Apple's App Store. Your Apple ID payment method will be charged.
- Refunds are subject to Apple's policies. To request a refund, please contact Apple Support.
- We may change Premium Plan pricing. Price changes will take effect at the next renewal. We will notify you in advance of any material price changes.

Article 5 - Prohibited Conduct
Users must not engage in any of the following when using the Service:

- Acts that violate laws or public order.
- Violence, threats, harassment or bullying.
- Sexual content or inappropriate depictions of minors.
- Fraud, impersonation, doxxing, copyright infringement, privacy invasion or spam.
- Unauthorised access, reverse engineering, or the use of bots or automation tools.
- Any conduct that infringes the rights or interests of third parties.
- Any other conduct that we deem inappropriate.

Article 6 - Moderation and Measures
- We may, without prior notice, delete or hide Content, or suspend or terminate accounts of Users who violate these Terms.
- Users can report inappropriate Content or conduct in-app.
- Users may block other Users.
- A content hiding feature allows Users to hide specific photos or comments from their own view.
- A kick feature allows Members to remove other Members from an Album.

Article 7 - Intellectual Property
- Intellectual Property Rights in the Service and in Content provided by the Company belong to the Company or its licensors.
- Users retain copyright in their posted photos and comments but grant the Company a royalty-free licence to use such Content for the purposes of providing and operating the Service.

Article 8 - Use of External Services
The Service uses the following external services:

- Firebase (Google LLC): Authentication, database, file storage, backend processing, push notifications and app configuration.
- Apple Sign-In: Authentication.
- Google Sign-In: Authentication.

Article 9 - Personal Data Handling
Collection, use, retention and disclosure of personal data are governed by our Privacy Policy.

Article 10 - Use by Minors
- The Service is intended for Users aged 13 or older. Children under 13 may not use the Service.
- Minors should obtain consent from a parent or guardian if required.

Article 11 - Disclaimer
- The Service is provided as is and as available. We make no warranties regarding its content or quality.
- We are not liable for any damages arising from your use of, or inability to use, the Service, except where liability cannot be excluded or limited under applicable laws.
- Users must resolve disputes with other Users at their own risk.

Article 12 - Changes to Terms
- We may modify these Terms as necessary. If we make material changes, we will notify Users via an in-app notice or other appropriate means.
- Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Article 13 - Governing Law and Jurisdiction
- These Terms are governed by the laws of Japan, except where mandatory consumer or data-protection laws of the User's country of residence apply.
- For disputes arising in connection with the Service, the Tokyo District Court shall be the exclusive court of first instance.
